The Association of Industries of the Dominican Republic (AIRD) called for a review of eight articles of Law No. 74-25, which establishes the new Penal Code, considering that its current wording could generate legal uncertainty for companies.
The entity understands that the modification process currently being reviewed by a bicameral commission of the National Congress constitutes the appropriate opportunity to introduce the necessary clarifications to such an important legal text.
In particular, the AIRD identified several articles that, in its view, require clearer wording to ensure respect for the principles of legality and due process, avoiding interpretations that could affect the legal certainty of companies. The industrial association proposes strengthening the wording of articles 8 through 13, as well as articles 150 and 151, without undermining the effectiveness of the criminal prosecution sought by this Code.
The AIRD maintained that the modifications that are finally approved must contribute to strengthening legal certainty, competitiveness, and the existence of a predictable legal framework that favors investment and the development of business activity in the country.
“The AIRD supports a modern and updated Penal Code for the Dominican Republic. Precisely for this reason, we consider it important that this modification process allows for the correction of provisions that, in their current wording, could lead to interpretations that affect the legal certainty of companies,” stated Mario E. Pujols, executive vice president of the AIRD.
The entity recalled that the bicameral commission, headed by deputy Wandy Batista and senator María Mercedes Ortiz, plans to submit its report before the end of the current ordinary legislative session, scheduled for next July 26.
