DIDA warns that it will take legal action if clinics suspend services to ARS affiliates

Santo Domingo. The General Directorate of Information and Defense of Social Security Affiliates (DIDA) reported that it will resort to the courts through a collective amparo action if private health centers suspend medical care to affiliates as a result of the disagreements they maintain with the Health Risk Administrators (ARS).

The director of the entity, Elías Báez, assured that the institution is prepared to act quickly in order to protect the citizens’ right to receive medical care without interruptions. He indicated that this right is supported by the Constitution, Law 87-01 of the Dominican Social Security System, and the General Health Law 42-01.

Báez maintained that the differences between the ARS and health service providers must be resolved through the appropriate legal channels, without affecting patients or limiting access to the benefits contemplated in the Family Health Insurance.

Likewise, he acknowledged that clinics have the authority to file their claims, but insisted that there are institutional mechanisms to channel those processes without resorting to measures that harm the members.

The official also recalled that the resources managed by the ARS are intended to guarantee the coverage of the Health Services Plan (PDSS), so their use must ensure the continuity of medical care established by law.

The DIDA indicated that it maintains constant monitoring of the situation and that, if necessary, it will exhaust all legal actions to prevent the rights of the affiliates from being violated.

Finally, the institution reiterated that its guidance and assistance channels remain available 24 hours a day, while urging system users to report any issues that limit access to health services.
