DIGEIG advances on the Conflict of Interest and Whistleblower Protection in Public Service bills

Santo Domingo.– The General Directorate of Ethics and Governmental Integrity (DIGEIG), in coordination with the Commercial Law Development Program (CLDP) of the United States Department of Commerce, began this Thursday a series of technical works aimed at consolidating the laws of Conflict of Interest and Protection of Whistleblowers, witnesses and victims, fundamental for the strengthening of the public integrity system of the Dominican Republic. Furthermore, in these working tables, the transformation process aimed at creating the system that structures and supports the legal and juridical basis for the operation of the General Directorate of Ethics and Governmental Integrity (DIGEIG) was addressed. During the opening of the works, the general director of DIGEIG, Dr. Milagros Ortiz Bosch, highlighted the importance of having clear, coherent rules aligned with the best international practices, which allow to prevent conflicts of interest, sanction their non-compliance and guarantee the effective protection of people who report acts of corruption. The sessions also have the technical support of the CLDP and the Ministry of Public Administration.

The working tables are also made up of representatives from the Senatorial Office of the Congressman for the province of Santo Domingo, Antonio Taveras, specifically in the elaboration of the Conflicts of Interest in Public Function Law Project, with the aim of providing the national legal system with such an important legal instrument for the strengthening of transparency, prevention and combating corruption. The working day will be analyzing in depth the preliminary draft law on conflicts of interest, addressing issues such as the general conflict regime, revolving doors, lobbying, cooling-off periods, the sanctions regime, the definition of gifts to public officials and transparency obligations in declarations of interests. These exchanges will allow progress towards an almost definitive version of the legislative text. In addition, technical discussions will be held on whistleblower protection, its principles, scope of application, secure reporting channels, identity protection, measures against retaliation, and institutional responsibilities. At the close of the sessions, a clear roadmap is expected to be defined for the completion of both preliminary drafts and their articulation with the future Organic Law Project for the creation of the Superintendency of Integrity, Transparency and Governmental Ethics (SITEG). In addition to representatives from the Commercial Law Development Program (CLDP) of the United States Department of Commerce, representatives from key public sector entities linked to the integrity system of the Dominican Republic also work at those tables, as part of an inter-institutional effort aimed at consolidating the regulatory and prevention framework for corruption in the country.
