Cuban Justice rejects the early release of dissident Otero Alcántara

Havana.- Cuba's Supreme People's Court (TSP) dismissed the appeal of artist and dissident Luis Manuel Otero Alcántara requesting his early release, considering that he had already served the prison sentence to which he was sentenced. In the 2026 ruling, to which EFE had access, the court rejected the appeal of the defendant, sentenced in 2022 to five years in prison for the crimes of "contempt, public disorder and outrage to the symbols of the homeland of a continuing nature". The decision is final. The defense argued that the artist was entitled to "eight months reduction" of sentence for the time he had already spent in prison and that his stay in the Guanajay penitentiary (west of Cuba) could be considered "illegal detention". However, the TSP considered that Otero Alcántara could not be granted that sentence reduction, since the benefit depends on "good behavior" and the artist "has maintained inappropriate behavior" with "multiple indisciplines" and has needed "coercive measures". The TSP entered into the merits of the matter after admitting the appeal of Otero Alcántara's defense after a lower court refused to address the issue. "Despite the adverse outcome, this process could set a relevant precedent for future legal actions in Cuba," argued Cubalex, an NGO specializing in legal assistance in Cuba, in a statement. In his opinion, the admission of the appeal by the TSP "opens a path that could be used by other families and people deprived of liberty for political reasons, consolidating Habeas Corpus as a key legal tool in defense against arbitrary detentions." Otero Alcántara, considered a prisoner of conscience by Amnesty International, has always denied the charges for which he was convicted and has denounced multiple abuses during his years in prison.
