Santo Domingo. - The Ombudsman voluntarily intervened so that the Third Chamber of the Supreme Court of Justice would annul and order the Superior Administrative Court to hear again the contentious administrative appeal against the decision that dismisses an officer of the Dominican Republic Navy (ARD).
The decision favors citizen Luis Fernando Evangelista de Oleo, who requested the intervention of the constitutional body because in 2023 an irregular dismissal occurred to his detriment, contrary to the constitutional principles that govern the actions of the public administration, violating the right to defense and the fundamental guarantees of due process.
Following the request, the Ombudsman developed a systematic dynamic of assistance and accompaniment by the Lcdos. Roberto Quiroz, Yajaira Sierra and Miguel Tapia, both in administrative headquarters and before the Superior Administrative Tribunal (TSA), due to the contentious administrative appeal against the decision of the Ministry of Defense.

Evangelista de Oleo, represented by lawyer Luis Alexander Santana Morla, filed an appeal in cassation under Law no. 2-23 on Appeal in Cassation, by virtue of which the Supreme Court of Justice quashed, due to defects such as the omission to rule and lack of motivation, Judgment no. 0030-03-2025-SSEN-00057, issued by the Second Chamber of the Superior Administrative Court (TSA), and ordered that the Fourth Chamber of the aforementioned court hear the appeal again.
This decision sets an institutional milestone for the Ombudsman's interventions, which adds to the series of results of the institution through actions in defense of people's fundamental rights.
