DGCP denies changes in advertising contracting

Santo Domingo.- The General Directorate of Public Procurement (DGCP) clarified that the exception procedure for contracting advertising through social and digital media or communication platforms has not undergone any changes with the entry into force of the new Law 47-25 on Public Procurement, despite information that has recently circulated in various media outlets. The institution explained that this exception procedure only applies when hiring is done directly with the media outlet, in accordance with the provisions of numeral 7 of article 78 of Law 47-25 and article 167 of its Implementing Regulation no. 52-26. In that sense, the DGCP specified that the hiring of media centers, advertising agencies or other intermediaries is not covered by said exception procedure, so these must be carried out through the ordinary selection procedures provided for in the national public procurement system.

These hires, the entity emphasized, must be governed by the principles of competition, transparency, and equal treatment, as stipulated by the general rules governing state purchases and contracts. Likewise, the DGCP reiterated its commitment to guide and support public institutions, suppliers, and the citizenry in general, with the aim of ensuring a uniform, transparent, and law-abiding application of current regulations, avoiding erroneous interpretations that may generate confusion about the scope of legal provisions.
