Investigation into Jarabacoa City Council tender that was not uploaded to the system

The General Directorate of Public Procurement (DGCP) reported this Wednesday that it was empowered by a complaint for alleged irregularities in the price comparison procedure no. AMJ-CCC-CP-2025-0001, carried out by the Municipal Council of Jarabacoa for the "Remodeling of the Community Hall of the Medina Urbanization".

According to the complaint received on July 11, 2025, the aforementioned procedure, carried out for an amount of RD$1,078,775.51, was not published in the Electronic Public Procurement System (SECP), which violates the principles of legality, transparency, and publicity. Non-compliance with the established deadlines and other provisions contained in the current regulations is also noted.

Faced with these indications, the governing body indicated that it initiated the instruction phase, with the purpose of gathering information, guaranteeing due process and adopting a well-founded decision, in accordance with the provisions of article 26 of Law No. 107-13, on the Rights of Persons in their Relations with the Administration and of Administrative Procedure.

Once this phase is completed, the analysis, weighting, and decision of the case will proceed, examining the principle of legality, compliance with Law 340-06 on Public Procurement, as well as Regulation 416-23 and the policies and guidelines issued by the DGCP, in order to determine the existence or non-existence of grounds for absolute nullity or voidability within the framework of the public procurement regime.

The institution reiterated its commitment to guarantee transparency and compliance with the legal framework, ensuring the correct use of public funds.
