TC orders PN payment to the widow of General Feliciano Castillo for non-compliance with the sentence

The Constitutional Court (TC) ordered the National Police to pay 3,610,000 pesos to Dulce María Lora Solís, widow of General José Antonio Feliciano Castillo, as a sanction for the non-compliance with a previous sentence.

This sum is added to another of 2,631,383.04 pesos that the institution already had to disburse, which raises the total debt to 6,241,383.04 pesos.

The origin of the conflict dates back to 2007, when Feliciano was denied the payment of his pension corresponding to the rank of brigadier general, the grade with which he retired.

The officer filed a claim with the Superior Administrative Court (TSA), but it was rejected in 2019. After that, the case was brought before the Constitutional Court (TC), although Feliciano died in 2020 without seeing his case resolved.

In 2022, the Constitutional Court issued a favorable ruling, ordering the PN to pay the pension with the rank of general, in addition to delivering the corresponding retroactive amount from 2007 to 2019, for a total of 2,631,383 pesos. Additionally, it imposed an astreinte of 5,000 pesos for each day of non-compliance with the resolution.

The widow, Dulce María Lora Solís, inherited the general's rights and has fought to receive the money. Finally, the TC published sentence TC/0364/25 on June 11, 2025, accepting her request for the liquidation of the astreinte and obliging the Police to deliver 3,610,000 pesos, resulting from multiplying 5 thousand pesos by 722 days of non-compliance.
