Harvey Weinstein found guilty of first-degree sexual assault

New York.- The jury that found Harvey Weinstein guilty of one count of first-degree sexual assault, and not guilty of another similar charge, will continue deliberating tomorrow on the remaining one, of third-degree rape, after a session interrupted by "screams and threats". The panel president, who minutes before the verdict on the first two charges had been announced, had reported an anomalous situation within the joint deliberations, detailed to Judge Curtis Farber -of the New York State Supreme Court-, to the Prosecution and to the defense that since Monday he has been suffering verbal attacks from some member of the jury. According to this jury representative, once the two verdicts were announced and after the recess for which the colleagues had left the court, another member said to him in a threatening tone: "I'll see you outside the court." Furthermore, he explained that in today's deliberation session there were other "shouts and threats", which is why he even requested not to sit with the rest of the panel members again.

Finally, he was redirected by Judge Farber, who had previously asked the jury to calm down and return tomorrow to decide on the last charge, and he allowed him to deliberate on Thursday individually, without having to access the room set up for the jury. Furthermore, the president revealed that since Friday they had already unanimously reached the two verdicts announced today, but that since then they have been stalled in the decision regarding the third-degree rape charge, which, with a maximum of up to 4 years in prison, also weighs on Weinstein. This charge relates to the lawsuit by actress Jessica Mann, who had a relationship with Weinstein and claimed to have been raped by him in a New York hotel in 2013. The jurors in his first trial in 2020, where he was sentenced to 23 years in prison in a conviction overturned last year in an appeals court, were also deadlocked on the charges related to her. During that trial, the jury determined that Weinstein was not guilty of first-degree rape in relation to his case, but did convict him of third-degree rape, which required the prosecution to prove only that she did not consent. "What is happening in that deliberation room has nothing to do with the trial. I am not having a fair process. It's time to end this, find a different jury without fights or threats, and start a new trial," stated Harvey Weinstein himself before hearing his first two verdicts. The defense of the Oscar-winning producer has not been able to speak to the press yet because they are currently under a 'gag order', which does not allow them to make public comments about the process, but they do not rule out that Weinstein may speak again tomorrow while deliberations continue.
