Madrid.— The High Court of Justice of Madrid (TSJM) has confirmed the suspension of the construction works of two underground car parks and a tunnel in the vicinity of the Santiago Bernabéu stadium, promoted by Real Madrid and authorized by the City Council of the capital.

In its ruling, the Contentious-Administrative Chamber dismissed the appeal filed by both entities against the ruling of the Contentious-Administrative Court number 30, which had sided with the Neighborhood Association of those Affected by the Bernabéu (AVPB). This resolution annuls the agreement of the Governing Board that allowed said constructions. The TSJM also imposed the payment of legal costs on the appealing parties, establishing a maximum of 6,000 euros for the Madrid City Council and 12,000 for Real Madrid Club de Fútbol. However, the ruling can be appealed in cassation within thirty days. The court maintains that neither the City Council nor the white club demonstrated that the execution of the parking lots responded to a public or general interest, as required by urban planning regulations, and warned about the negative environmental impact, including the possible elimination of green areas and the increase in atmospheric and acoustic pollution. Likewise, the magistrates agreed that the execution projects infringe the 2017 Special Plan (PE), relying on the technical reports presented by the neighborhood association, which they considered as valid as those provided by the administration. The ruling also indicates that the planned 650-meter tunnel to connect the parking lot on Padre Damián street with the stadium's parking lot primarily responds to a private interest of Real Madrid, without objective evidence that it helps alleviate traffic congestion in the area.Following the first failure, issued a year ago, the mayor of Madrid, José Luis Martínez-Almeida, ordered Real Madrid to stop the works, guarantee the safety of the area and restore the affected surfaces to avoid damage to the mobility around the stadium.
