CNSS adapts age limit and deadlines for pensions following Constitutional Court ruling

The National Council for Social Security (CNSS) adapted the Disability and Survivorship Policy Contract of the contributory regime to the ruling of the Constitutional Court, which modified the age limit and deadline to claim a pension.

The policy contract is an agreement between the Pension Fund Administrators (AFP) and insurance companies, with the aim of guaranteeing a pension to the affiliate of the Dominican Social Security System (SDSS) in the event of disability, and in case of death a pension for their relatives.

The coverage of the Old Age, Disability and Survivor Insurance begins for each affiliate, from the moment their employer makes the payment to the Social Security Treasury (TSS), of the corresponding social security contributions through the authorized payment methods, which must be informed to the AFP contracting the insurance policy.

CNSS Resolution No. 624-05 stipulates that at 65 years of age, the disabled affiliate continues with the assigned pension, which guarantees that they remain with their health coverage and a lifetime pension.

This decision by the governing body of the SDSS guarantees the continuity and sustainability of the coverage for affiliates, avoiding interruptions in protection or in the receipt of the benefit.

The resolution establishes that in order to adapt the complementary regulations to the new Policy Contract, the Superintendency of Pensions (SIPEN) must make the corresponding modifications within 60 calendar days.

The CNSS instructs the Social Security Treasury (TSS) and the Database Processing Company (UNIPAGO) to make the necessary technological adjustments within a period not exceeding 10 business days so that contributions to the Disability and Survivor Insurance of workers aged 65 years or older are dispersed to the corresponding item of said insurance.

It was determined that the TSS, within a period not exceeding 10 business days, should make the necessary adjustments to allow insurance companies to make payments of Social Security withholdings at the time of the first payment, without generating late fees and interest.

It was established that the Insurance Policy Contract approved by this resolution will be temporary, until a modification of Law 87-01 in force regarding this benefit occurs, taking into account the principles of financial sustainability, equity and other foundations that govern the Dominican Social Security System.
