The National Competition Defense Commission (Pro-Competencia) welcomed the circular issued by the General Directorate of Public Procurement (DGCP) regarding the requirement for the manufacturer's authorization certification in public procurement processes.
The institution highlighted that this provision incorporates several recommendations contained in its “Public Recommendation Report on Terms of Reference in Procurement Processes of the Social Plan of the Presidency and Economic Dining Halls of the State: Identification of Barriers in the Procedures”, sent to the Social Assistance Plan of the Presidency and the Economic Dining Halls of the State with a copy to the DGCP and the General Directorate of Ethics and Governmental Integrity (DIGEIG) on November 28, 2024 and resent on April 16, 2025.
This requirement, as it is not based on an essential technical justification nor contemplated as mandatory by public procurement regulations, tends to favor certain suppliers to the detriment of free competition, the agency specifies.
Pro-Competition recommended eliminating this requirement when it is not essential to guarantee the quality of the acquired good, underlining that its unjustified use limits the diversity of offers and can raise costs for the State.
In this regard, the DGCP circular specifies that "the requirement for this document can become an excessive requirement, limiting the equality and free competition of the bidders."
