Senate approves creation of the Ministry of Justice and establishes new National Human Rights System

Its central objective will be to promote inter-institutional cooperation in the formulation and execution of policies that guarantee the protection and promotion of human rights in the country.

Santo Domingo.- The plenary of the Senate of the Republic approved this Thursday, in second reading, the bill that creates the Ministry of Justice. This new entity, if ratified by the Chamber of Deputies and promulgated by the Executive Branch, would establish a National Human Rights System with the purpose of coordinating public policies related to fundamental rights in the country. It will also allow to respond to the legal and technical requirements formulated by international organizations specialized in this field. According to the legislative proposal, this system will not operate as a commission or as a deliberative or consultative body. Rather, it is proposed as a common space for exchange, where public institutions and civil society organizations linked to the area of human rights will participate.

The new Ministry of Justice will have as one of its main functions to coordinate the attention provided by the Executive Branch to the Justice System. This system is made up of the National Council of the Magistracy, the Judicial Council, the Constitutional Court, the Superior Electoral Tribunal, the Public Ministry, the National Office of Public Defense and the National Police. Likewise, the ministry will be responsible for coordinating the Penitentiary and Correctional Services System and for formulating the corresponding public policies in that area. In addition, the ministry will be responsible for representing and defending the State and the Public Administration before the competent jurisdictional bodies. This representation will also extend to arbitration forums and other alternative dispute resolution mechanisms, as stipulated by law.
