Public Ministry appeals Alexis Medina's sentence and requests 20 years in prison

Santo Domingo.- The Public Ministry filed an appeal on Monday against the sentence that only imposes seven years in prison on Juan Alexis Medina Sánchez and requested instead that the defendant, accused of administrative corruption, be sentenced to 20 years in prison and a fine of 400 minimum wages.

The Court's attorney, Mirna Ortiz, indicated that with this appeal, the prosecuting body reaffirms its disagreement with the sentences imposed by the judges of the Second Collegiate Tribunal, which, in addition, acquitted several of the defendants.

"We have filed, before the Presidency of the Court of Appeals of the National District, the appeal to the decision issued by the Second Collegiate Tribunal of the National District, composed of judges Claribel Nivar, Giselle Soto and Clara Castillo," Ortiz, head of the Specialized Prosecutor's Office for the Prosecution of Administrative Corruption (Pepca), pointed out.

The Public Prosecutor's Office requests that Medina Sánchez also be subjected to civic degradation, in accordance with the provisions of the Criminal Code to remove or exclude those convicted from public functions, employment or positions, as well as other limitations of rights established by the legislator to safeguard the interest of society. For José Dolores Santana Carmona, the Public Ministry requests that he be sentenced to 15 years in prison, a fine of 400 minimum wages, and civic degradation. In the case of Fernando Aquilino Rosa Rosa, acquitted by the Second Collegiate Court, it is requested that he be sentenced to ten years in prison, a fine of 400 minimum wages, and civic degradation. It also requests a 10-year sentence, a fine of 400 minimum wages, and civic degradation for Carmen Magalys Medina Sánchez, sister of the defendant Juan Alexis Medina Sánchez, and for Wacal Vernabel Mendez Pineda. Regarding Carlos Jose Alarcón, Libni Arodi Valenzuela Matos, Paola Mercedes Molina, Carlos Martin Montes de Oca, Rigoberto Alcántara Batista, José Miguel Genao Torres, Antonio Florentino Méndez and Fulvio Antonio Cabreja Gómez (Angelo), the Public Ministry requests the imposition of ten years of major imprisonment and the payment of a fine of 200 minimum wages. The prosecution requests a sentence of five years' imprisonment, and the payment of a fine of 200 minimum wages, for Ramón Brea Morel (Jhonny Brea), while, for Lima Ercilia de la Cruz Vargas, Pachristy Emmanuel Ramirez Pacheco and Lorenzo Wilfredo Hidalgo Núñez, it seeks five years in prison, the payment of a fine of 200 minimum wages and civic degradation. Regarding Aquiles Alejandro Christopher Sánchez, the Public Ministry requests the imposition of two years of suspended imprisonment and civic degradation, and for Rafael Antonio Germosén Andújar, a sentence of five years of suspended imprisonment, the payment of a fine of 200 minimum wages, and civic degradation. For the companies Centro de Medicina Reproductiva Integral y Atención Femenina (CEMERAF), Editorama, and R&T Construcciones e lnversiones, the accusing body requests that they be prohibited from contracting with the State, their dissolution, closure, and shutdown, as well as the cancellation of their licenses, rights, and administrative and state authorizations, in addition to a fine of 200 minimum wages. In the process, the judges established that the collection of evidence complied with due process of law. Medina Sánchez, who led the corruption scheme, was found guilty of bribery in commerce and investment, money laundering, use of false documents, and association of wrongdoers, for which he was sentenced to seven years in prison. The court also sentenced José Dolores Santana Carmona to 6 years in prison and 5 years to Wacal Vernabel Méndez Pineda, Francisco Ramón Brea Morel, Carlos Martín Montes de Oca, Rigoberto Alcántara Batista and Paola Mercedes and Víctor Matías Encarnación. The defendants Medina Sánchez, José Dolores Santana Carmona, Wacal Vernabel Méndez Pineda, Paola Mercedes and Rigoberto Alcántara Batista and several companies must pay 500 million to the Dominican State. Also, the companies Domedical Supply SRL; Fuel American Inc.; General Supply Corporations SRL; General Medical Solution AM SRL; Kyanred Supply SRL; Suim Suplidores Institucionales Méndez SRL; United Suppliers Corporations SRL; WattmaxDominicana SRL; WMI International SRL; Wonder Island Park SRL; Acorpor SRL; Ichor Oil SRL; Globus Electrical SRL; Contratas Solution Services CSS SRL; Constructora Alcántara Bobea (CONALBO) SRL; Proyectos Engineering & Construction PIC SRL; Reivasapt Investment SRL; Suhold Transporte y Logística SRL. Juan Alexis Medina Sánchez and the other convicts must serve their prison sentences in the Najayo Men's and Najayo Women's correction and rehabilitation centers, in the province of San Cristóbal, in addition to paying the penal costs of the process. Under the agreement reached with the Public Ministry, the defendant Víctor Matías Encarnación Montero was found guilty and sentenced to 5 years in prison, with the court ordering the suspension of the sentence, subject to rules, including residing at the address that was notified to the court. He was also sentenced to pay the criminal costs and a fine of 500 thousand pesos. Meanwhile, Fernando Rosa, Carmen Magalys Medina, Freddy Hidalgo, Rafael Antonio Germosén Andújar, Lina Ercilia de la Cruz Vargas, Pachristy Emmanuel Ramírez, Carlos José Alarcón, Libni Arodi Valenzuela Matos, José Miguel Genao Torres, Antonio Florentino Méndez, José Idelfonso Correa Martínez, Aquiles Alejandro Christopher Sánchez and Fulvio Antonio Cabreja Gómez were acquitted. Also, the companies Cemeraf and Editorama were acquitted of money laundering and released from paying the legal costs of the process.
