The Dominican Association of Councilors disagrees with the FEDOMU ruling

Padre Las Casas.– Councilor Sandy Báez described as worrying the decision supported by the Dominican Federation of Municipalities (FEDOMU), regarding the interpretation that the urban planning offices of the town halls and not the councils of councilors are responsible for granting permits for land use and construction.

Báez warned that if this measure were applied, the power of oversight and approval granted by the Constitution to municipal councils would be nullified. "If that attribution is eliminated, then what is the role of the councilors in making fundamental decisions?", he questioned. The statement is made amidst the debate generated by the ruling TC/1373/25 issued by the Constitutional Court, in response to a direct action of unconstitutionality against a resolution of the Council of Councilors of the municipality of Higüey. In response, the Dominican Association of Councilors (ASODORE) has expressed its rejection of any attempt to weaken the constitutional role of municipal councils, reiterating that the normative and supervisory function is established in Article 201 of the Constitution. Báez supported ASODORE's position and stated that this ruling could set a serious precedent against municipal autonomy and democratic balance in local governments.
