PCT condemns ruling that seeks to strip the State of land in Jaragua National Park

Santo Domingo. – The Secretariat of the Communist Party of Labor (PCT) strongly condemned sentence no. 0030-1643-2025, issued on November 20 by the Superior Administrative Court, considering that it constitutes a new and serious attack against the national heritage, by attempting to dispossess the Dominican State of more than 28 million square meters located within the Jaragua National Park. The political organization described the decision as a “robbery of the country”, pointing out that it can only be explained by the persistence of a legal framework that favors impunity, the actions of “white-collar” interests, and the existence of judicial practices contrary to the public interest. According to the PCT, this is a new scandal in which justice is instrumentalized to favor business and political sectors to the detriment of a strategic asset for national development and environmental protection.

From a legal standpoint, the PCT argued that the ruling should give rise to legal actions against the judges who support it and against the beneficiaries, recalling that the limits of a national park cannot be modified without a law approved by two-thirds of the congressional roll, as they are protected by an organic law, in accordance with article 112 of the Constitution of the Dominican Republic. The organization warned that the conflict transcends the strictly legal and takes on a highly serious political character, as it could open the door to the revision of historical confiscations of assets linked to the Trujillo dictatorship, favoring attempts to rehabilitate Trujilloism and ultraconservative currents that seek to rewrite national history. Likewise, the PCT warned that, if this decision were to succeed, the entire National System of Protected Areas would be put at risk, due to the repeated plans and pressures that, at different times, have tried to dismantle it to benefit private interests. Finally, the Communist Party of Labor called for the mobilization of the citizenry, academic and research centers, environmental movements, and responsible public opinion, in order to defeat the sentence and defend the natural heritage and environmental sovereignty of the Dominican Republic.
