Santiago.-Judge José Rafael de Asís Burgos, coordinator of the Instruction Courts of the judicial district of Santiago, imposed this Wednesday three months of preventive detention as a coercive measure against two men and a woman involved in the incident that occurred in the vicinity of the Cibao International Airport, where a woman allegedly injured a Digesett agent with a scalpel, while another uniformed officer was also injured during the altercation.
The measure was dictated against Franmy Gutiérrez Feliz, Darleny Lisbet Rodríguez Rodríguez and Joss Antonio Gutiérrez Feliz, who must comply with the coercion in the correction and rehabilitation centers of Rafey Hombres and Rafey Mujeres, as appropriate.
The case originated during an inspection for illegal parking at the airport terminal, a situation that led to a brawl between agents of the General Directorate of Traffic and Ground Transportation Safety (Digesett) and the now-accused, an event that generated widespread uproar after several videos circulated on social media.
According to the request presented by the Public Ministry, the defendants face provisional charges for alleged violation of articles 265 and 266 of the Dominican Penal Code, which typify the association of wrongdoers; article 209, relating to rebellion against authority; as well as articles 309 and 310, related to aggravated blows and injuries, due to the alleged premeditation or ambush.
According to the preliminary version of the authorities, before the confrontation occurred, Darleny Lisbet Rodríguez Rodríguez had disseminated a video on social media in which she is observed uttering insults against the agents who were trying to inspect her. Subsequently, during the struggle, one of the agents would have been injured with a scalpel, while another was injured in the midst of the confrontation.
In the development of the incident, and according to the official version, one of the agents reacted and allegedly struck the woman in the face with the handle of his service weapon, in the midst of the confrontation.
When approached by the press after the judicial decision was announced, the accused rejected the measure and claimed they acted in response to alleged abuse by the officers.
"That's wrong, because you know it, you watch the videos... one responded like that because of the abuse that those people have, do you understand me?" expressed one of the accused, while asking that the case be investigated thoroughly.
For her part, Darleny Lisbet Rodríguez Rodríguez, identified as the person who allegedly injured the Digesett agent with the scalpel, also offered statements after the hearing, amid the media attention that the case has generated.
The Public Ministry had requested the imposition of three months of preventive prison, a request that was accepted by the court considering, at this initial stage of the process, the seriousness of the events and the need to guarantee the development of the investigation.
The incident, which occurred in a high-traffic area of the Cibao International Airport, has reignited the debate in Santiago about the limits of authority during inspection processes, as well as the reaction of citizens in scenarios of confrontation with law enforcement officers.
