Lawyers challenge sanction against them for alleged frivolous litigation

Lawyers Mariel León, Lilia Fernández León, and Joel Del Rosario refuted the disciplinary sanction issued against them for alleged reckless litigation. They described it as legally flawed and unfounded, as it was imposed in a hearing to which they were not summoned and in which they were denied the right to defense, both for themselves and for their client.

The sanction originates from the divorce process in which she represents a woman who took legitimate actions to preserve her marital assets against proven maneuvers of distraction and fraud. Although they were not listed as defendants nor were they summoned to the process, the three lawyers were sanctioned along with their client after a judicial opposition before commercial banks.

"The sentence was handed down without us being part of the process. It is arbitrary and unsustainable in law because it misrepresents the facts for the benefit of one of the parties," they stated in a joint declaration. They confirmed that they have already challenged the resolution through the corresponding legal channels.

The jurists added that the dissemination of the case has been staggered and deliberate, driven by social media profiles and amplified by a media outlet that dedicated ample space to it.

"A media operation aimed at disprotecting a woman in a situation of legal vulnerability and discrediting her defense team is warned," they pointed out.

Although they emphasized that they do not litigate in the media, they underline that the unprecedented repercussion of this unlawful decision obliges them to speak out publicly to protect their trajectory and the cause they represent.

"We will continue to act with integrity and firmness, strictly adhering to due process. We trust that the competent courts will rule in accordance with the law, both with respect to the challenged sanction and in favor of the rights of the most vulnerable party in this case," they concluded.
