Santo Domingo.– Attorney Félix Porte, representative of several of the victims of the Jet Set tragedy, questioned the Public Ministry for the legal qualification presented against the defendants Antonio and Maribel Espaillat.
Porte assured that, unlike the Public Ministry, the legal representation of the victims maintains an accusation of voluntary homicide with eventual intent, while the Prosecutor's Office maintains a theory that, according to him, is "identical" to that of the defense of the accused. "It's the first time in 23 years of practice that I've seen the Public Ministry with the same factual theory as the defense. They spent six months and six days investigating, and unfortunately, the mountain gave birth to a mouse," he expressed. The lawyer regretted that a more severe charge had not been made, in accordance with the magnitude of the case. "We are talking about 236 people who died, 180 injured, and even so the Public Prosecutor's Office did not formulate a forceful legal qualification that reflects the dimension of this tragedy," he said. You can read: Coercion measure request for the Espaillat brothers postponed
Porte explained that, although Antonio Espaillat did not have the direct intention of causing death, "he had all the warning signs, ignored them and decided to continue operating that commercial establishment", which in his opinion constitutes a clear form of eventual intent.
